NSRP Act (2015)

The NSRP Act (2015) empowers the HSRA to

“take enforcement measures in the event of threatened or actual non-compliance with this Act, the regulations or the terms and conditions of authorizations.” (Section 7, Subsection 1 (e)).

The HSRA is also required by the Act to:

“establish system of enforcement to ensure compliance with applicable regulations and the terms and conditions of authorizations for radioactive waste and spent fuel management activities.” (Section 98. (e))

Enforcement & Compliance

The Enforcement arm of the HSRA aims to establish and execute Enforcement Instruments necessary to assure compliance among users of ionizing radiation when deviations from legislation or from terms and conditions of authorization, are detected. Enforcement Instruments seek to achieve the following:

Ensuring Compliance Through Enforcement

Deterrence of Noncompliance

The entity is in compliance with applicable laws, regulations and authorization conditions and all relevant codes, guides, specifications and practices.

Prompt Correction of Violations

Encourage prompt identification and prompt comprehensive correction of violations of HSRA requirements.

Verbal & Written Warnings

Verbal and/or written warnings issued to entities found in violation of regulatory requirements.

Suspension & Revocation

Suspension/revocation of authorization and subsequent orders to cease and desist radiation activities.

Seizure of Items

Seizure of items (i.e. radiation generating equipment or radioactive sources).

Prosecution

Prosecution of entities or persons who fail to comply with regulatory requirements.
Enforcement supports the HSRA’s mission to ensure adequate protection of public health and safety, promote the common defence and security, and protect the environment. Compliance with requirements, including regulations, technical specifications, and authorization conditions, provides reasonable assurance to the HSRA and the public that safety and security are being maintained. The HSRA maintains a register of active enforcement instruments for non-compliant facilities/entities.
